Copy of S106 Agreement and Variations for Kennett Garden Village

I am writing to submit a request under the Freedom of Information Act 2000.
I wish to obtain a full copy of the Section 106 Agreement associated with planning application:
• Application Reference: 18/00752/ESO
• Site: Kennett Garden Village, Land Southwest Of 98–138 Station Road, Kennett
• Developer: Bellway Homes Limited (Eastern Counties)
This request should include:
1. The complete S106 Agreement, including all signed schedules and appendices.
2. The Open Space Adoption and Maintenance Schedule, specifying:
• Long-term maintenance responsibilities
• Any management company obligations
• Any intended transfer to the District or Parish Council
3. Any subsequent deeds of variation relating to the same development.
4. Any associated plans or maps referenced within the agreement (e.g., open space plans, SUDS plans, public realm areas).

The layout of this application was subsequently varied by application 23/00320/VARM (the documents of which are available here: https://pa.eastcambs.gov.uk/online-applications/applicationDetails.do?activeTab=documents&keyVal=SGITIFGGGVD00). - There are no Deeds of Variation in addition to that dated 05 December 2023.

- East Cambridgeshire District Council approved the Public Open Space Scheme as defined in the S106 Agreement in relation to Phase 1 of the development 21 August 2023. The documents that form this Scheme are available to access as follows:

The Cover Letter confirms, in relation to Phase 1 of the development, the long-term maintainer of the Public Open Space and the funding mechanism.

The Public Open Space for Phase 1 of the development is to be adopted by Kennett Community Land Trust, as detailed in the approved Public Open Space Scheme referenced in answer to C. The terms of transfer are defined as part of the S106 Agreement under Schedule 2 Part 2 (also see the relevant Definitions under Clause 1 of the S106 Agreement).
East Cambridgeshire District Council has no records of any transfer agreements at the time of response. - See D.
